Terms of service
These terms are the agreement between you and Martori Studio, which makes Thermal. Using Thermal means you accept them, along with the privacy policy. Questions go to hello@martori.studio.
Who can use Thermal
You must be at least 13, or the minimum age for this kind of service where you live, and able to agree to these terms. If you use Thermal for a band, label or company, you confirm you may agree for them.
Your account
Keep your sign-in to yourself and tell us at hello@martori.studio if you think someone else has used it. You are responsible for what happens under your account.
Your music and what you make
- Your music, words, images and everything Thermal makes for you are yours, as far as the law allows.
- You give Martori Studio permission to store, process and show your content only as needed to run Thermal for you: to read your music, make what you ask for, keep your work, publish the pages you publish, and send what you choose to the services you choose.
- You confirm you have the rights to what you upload, publish or post, including the recordings, samples, artwork, likenesses and words in it.
What Thermal writes and makes
Thermal uses AI models to write and to make images, video and speech. What they produce can be wrong, can resemble other work, and is not legal, financial or professional advice. Read it before you use it; you decide what you publish and send. Thermal does not promise placements, playlist adds, press, streams or any other result.
Accounts you connect
- When you connect SoundCloud, Instagram, Facebook, TikTok or YouTube, you allow Thermal to act on that account only when you press the button that names it: to upload or post the file and words you chose, at the time you chose.
- Each platform's own terms still apply to you, including the YouTube Terms of Service when you post to YouTube and TikTok's Music Usage Confirmation when you post to TikTok.
- A platform can refuse, delay or remove a post. Thermal tells you what it said when it can.
- You can disconnect an account in Thermal at any time, and remove Thermal's access in the platform's own settings.
Using Thermal fairly
Do not use Thermal to:
- publish or post anything you do not have the rights to, or that is unlawful, deceptive, hateful or harassing;
- pretend to be someone else, or post to an account that is not yours;
- send spam, or get around a limit or a platform's rules;
- break, overload, probe or copy Thermal, or use it to build a competing service from its output in bulk.
Martori Studio may remove content or suspend an account that breaks these rules.
Plans and payment
- Prices are on the pricing page and are charged through Stripe, with any tax that applies.
- A subscription renews each period until you cancel it in the billing portal; cancelling stops the next renewal.
- A one-time purchase, such as a single kit, is charged once.
- If a charge looks wrong, write to hello@martori.studio.
Free and guest use
Free use has limits, which can change. A guest's work is deleted after seven days unless it is moved into an account.
Other services
Thermal links to and works with other services, from distributors to streaming services. They are run by others, under their own terms, and Martori Studio is not responsible for them.
Changes to Thermal and to these terms
Thermal changes as it is made better, and a feature can be changed or ended. When these terms change, the date at the top changes, and a change that matters will be shown in Thermal or sent to your email before it applies. Using Thermal after that means you accept the new terms.
Ending
You can stop using Thermal at any time and have your data deleted (see deleting your data). Martori Studio may suspend or end an account that breaks these terms, and will say why unless the law or safety prevents it.
No guarantees
Thermal is provided as it is and as available. To the extent the law allows, Martori Studio makes no promises beyond those in these terms, including that Thermal will always be available or free of errors.
Limits on liability
To the extent the law allows, Martori Studio is not liable for indirect or consequential losses, or for lost profits, data or opportunities, and its total liability to you is limited to what you paid for Thermal in the twelve months before the claim. Nothing in these terms limits liability that the law does not allow to be limited, or your rights as a consumer.
